TERMS AND CONDITIONS By accessing, browsing or using this website, you agree to the terms, conditions and disclaimers herein as amended from time to time. By purchasing an item advertised on this website and/or by completing the registration process to become a member of Fratelli Fresh. You agree to be bound by these Terms and Conditions. Fratelli Fresh may amend these Terms and Conditions from time to time and any amendment will become effective immediately. Your continued use of this website after amendment constitutes an agreement to abide by and be bound by those Terms and Conditions, as amended. Fratelli Fresh website is owned and operated by Fratelli Fresh Pty Ltd (Australian Business Number: 80 105 445 967).
Order Refunds Should you need to cancel your order, money will be refunded less a $10.00 administrative fee, ONLY IF notice is received by Fratelli Fresh 48 hours prior to the scheduled delivery date. Cancellations received with less than 48 hours notice will be charged at 50% of the total order value. We are unable to cancel orders that are already prepared and are with our courier for delivery.
Product Returns In the event of any problems with items purchased from, and delivered by FratelliFresh, the items may be returned to the warehouse store for exchange. Products must be accompanied with the Fratelli Fresh invoice.
Fratelli Fresh guarantees to deliver premium quality, market fresh produce direct to your door. If you are dissatisfied with any perishable item, we will gladly discuss with you any requests for a credit to your Fratelli Fresh account or your credit card for the amount in question.
Product Labelling Fratelli Fresh does not warrant the accuracy of the information contained in the product list and recommends that you read the labels on the goods carefully before consuming the goods.
Delivery Fulfilment If there are no delivery instructions advised, your order will be left at your front door and we take no responsibility for missing orders once delivered. Where there are no instructions and there is no place deemed appropriate to leave the order, it will be returned to the warehouse and await collection at your own arrangement. If you request that the order is redelivered by Fratelli Fresh on the next available delivery day to your area, an additional delivery fee will be incurred.
LIABILITY
USE OF SERVICE You agree not to use our products or services for any unlawful purpose (whether known or not) or in any manner which may infringe or violate any third parties rights. You further agree that you will not use our online service to transmit or upload any harmful files or unsolicited e-mail addresses. You further agree that you will not use our online service to transmit any unsolicited messages. In the event that you, any one logged into your account, causes any IP address owned or managed by Fratelli Fresh to be listed on any blacklist e.g. SORBS, you irrevocably agree to pay $150 per IP address listed and all fees associated with its removal.
Disclaimer Fratelli Fresh does not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with use of the Fratelli Fresh home online home delivery service.
Fratelli Fresh will not accept liability to you in respect of any loss or damage (including indirect, special, or consequential loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly in respect of goods or services supplied pursuant to an order placed on this web site or in respect of any failure or omission on our part to comply with our obligations as set out in these terms and conditions.
